Use of the site

Eligibility

By accessing or using damanclub.shop (the "Site"), you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements under applicable Indian law, and agree to comply with these Terms of Service in full. If you do not meet these conditions, you must discontinue use of the Site immediately. Daman Club reserves the right to verify eligibility at any time and to suspend access pending verification.

Permitted use

You may access the Site solely for lawful purposes and in a manner consistent with all applicable local, state, national, and international laws and regulations, including the Information Technology Act, 2000 and rules framed thereunder. You agree not to: transmit any unlawful, harmful, defamatory, obscene, or fraudulent content; attempt to gain unauthorised access to any part of the Site or its servers; introduce viruses or malicious code that may disrupt the Site's infrastructure; scrape or harvest data without our prior written consent; or impersonate Daman Club, its staff, or any other person or entity.

Account responsibilities

If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You must notify us immediately at [email protected] if you suspect any unauthorised use. Daman Club reserves the right to suspend or terminate accounts that violate these Terms at its sole discretion without prior notice.

Intellectual property

Ownership

All content published on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the exclusive property of Daman Club or its content licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian intellectual property laws. The Daman Club name, logo, and all related marks may not be used without our express written permission.

Limited licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only. This licence does not permit you to reproduce, sell, or exploit any portion of the Site or its content for commercial gain; modify or create derivative works without prior written authorisation; or remove any copyright, trademark, or proprietary rights notices displayed on the Site.

User-submitted content

If you submit any content to the Site, such as reviews, comments, or feedback, you grant Daman Club a worldwide, royalty-free, irrevocable, sub-licensable licence to use, reproduce, modify, publish, and distribute that content in any medium. You warrant that you own or hold the necessary rights to such content and that it does not infringe any third-party intellectual property rights.

Limitation of liability

Disclaimer of warranties

The Site and all content, services, and materials available through it are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Daman Club does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Site is entirely at your own risk.

Cap on liability

To the fullest extent permitted under applicable Indian law, Daman Club, its directors, employees, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Site, even if we have been advised of the possibility of such damages. This includes, without limitation, loss of data, loss of profits, business interruption, or payment failures arising from third-party processors outside our direct control.

In no event shall our total aggregate liability to you exceed the amount, if any, actually paid by you to Daman Club in the thirty (30) days immediately preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Daman Club and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your infringement of any third-party rights.
